Mediation

An effective dispute resolution mechanism

Accredited and CMC Registered Civil & Commercial Mediator in England and Wales

What is Mediation

Mediation is a form of alternative dispute resolution (ADR).

It is a mechanism that assists individuals and businesses in conflict to resolve their disputes by exploring potential solutions and reaching an agreement, with the assistance of the Mediator.

The Mediator is an objective and impartial third party, which assists the parties towards an agreement and the resolution of their dispute.

The private and confidential nature of the mediation creates an excellent and comfortable environment to the participants that with the assistance of the Mediator may lead to the voluntary resolution of the conflict.

Qualifications

I am an Accredited Mediator through the London School of Mediation and I am a Registered Mediator with the Civil Mediation Council (CMC) in the UK.

The Civil Mediation Council is the biggest registering organisation for mediation in England and Wales.

Feel free to click here to find my registration on the CMC Website.

How does Mediation work

Mediation can be conducted face-to-face in a venue arranged by the Mediator or remotely via telephone/video, whichever method is more convenient for the parties.

Before the mediation, both parties send an outline of the case, its background and dispute to the Mediator. After the mediation, all documentation is securely destroyed.

Mediation can be conducted in open or private sessions, according to the nature of the dispute and the needs of the parties. During the session, the parties, with the assistance of the Mediator, try to discover a potential agreement.

If the parties reach an agreement during the mediation, a settlement agreement shall be drafted by the parties’ legal representatives and shall be legally binding.

What types of Mediation do you undertake

I hold civil and commercial mediations in England and Wales. These involve parties that seek to resolve civil and commercial disputes, respectively.

The disputes can be between private individuals, organisations and businesses. These mediations deal with a variety of civil and commercial sectors and transactions, such as contract terms or breach for goods and services, company sale or purchase, real estate and fraud.

The fees for civil and commercial disputes are in accordance with the last published Civil Mediation Council Fixed Fee Mediation Scheme. The cost is split between the two parties and depends on the mediation session and the complexity of the case.

If you want to find out more about the nature of your dispute, sessions' length and relevant fees, please feel free to contact me.

Also, we have a full Complaints Procedure in compliance with CMC requirements; feel free to click here to read it.

How can I benefit from Mediation

Mediation can be organised quickly and is time-efficient, as you can enter into mediation and resolve your dispute within one day, if successfully reaching a settlement agreement.

Further, it results in substantial cost savings, as you can avoid legal and Court expenses as well as protect your wellbeing or business reputation with resolving the dispute in a faster manner.

A mediation can be held during an ongoing legal action or before it is even taken. Therefore, it provides you with flexibility and an alternative effort to resolve your dispute before even its legal escalation or during any stage of the legal battle.

During the mediation, you are not required to act or agree to a resolution that does not fit within your interests; it is a completely voluntary procedure.
